Terms of Service

1. Definitions

1.1. Public Offer (hereinafter - the "Offer") - a public proposal by the Hosting Provider addressed to an unlimited number of persons with the purpose of entering into a remote service agreement (hereinafter - the "Agreement") with the User on the terms set out in this Offer, including all clauses.

1.2. Hosting Provider - the principal entity providing the services.

1.3. User/Client - an individual or legal entity using the services of the Hosting Provider.

1.4. Service - a product available for order by Users, purchased for a specific period.

1.5. Billing - the User's personal account through which interaction with the Hosting Provider's Services takes place, including information about the User and all Services provided.

1.6. Domain/Domain name - a unique name used to identify resources on the internet.

1.7. Domain name registrar - an organization or company authorized to register domain names in a specific domain zone.

1.8. Domain zone - a part of the internet that defines the rules for domain name registration (e.g., .fr, .net, .org).

1.9. Domain registration - the process of registering a unique domain name on the internet through an accredited registrar. The domain name becomes the address for accessing a website or other online resources. When registering a domain, the owner's details, registration period, and name servers are specified.

1.10. Domain renewal - the procedure for extending the registration period of a domain name after the initial period expires.

1.11. Domain delegation - the process of linking a domain name to the IP address of the server where information about that domain is stored.

1.12. Domain transfer - the process of moving a domain name from one registrar to another. During a transfer, the organization managing domain registration changes, but the domain name itself remains unchanged. A transfer may require confirmation from the domain owner and compliance with certain rules and procedures established by the current and new registrars.

2. General Provisions

2.1. An Order for a Service on the Hosting Provider's website - items selected by the Client from the range of Services offered for order when placing an order to purchase a Service on the Hosting Provider's website.

2.2. Ordering a Service by the User on the Hosting Provider's website means that the User agrees to all terms of the Offer.

2.3. The administration of the Hosting Provider's website has the right to make changes to the Offer without notifying the Client.

2.4. The Offer is valid for an unlimited period.

2.5. The Hosting Provider provides the Client with complete and accurate information about the Service and its location.

3. Pricing

3.1. The price for each Service item is indicated on the Hosting Provider's website and in the billing system.

3.2. The Hosting Provider has the right to change prices for any Service items.

3.3. Changes to service prices take effect from the moment of publication of the new prices on the official website of the company and/or by sending a notice to the client at least 7 (seven) days before the changes take effect.

3.4. The Hosting Provider undertakes to notify all clients of upcoming price changes by posting information on the official company website and/or by sending notifications to clients' email addresses.

3.5. If a client disagrees with the new prices, they have the right to cancel services before the changes take effect.

3.6. The Client's payment obligations for a Service are considered fulfilled from the moment funds are received by the Hosting Provider.

3.7. Payments between the Hosting Provider and the Client for a service are made exclusively using the methods indicated on the Billing website.

4. Purposes of Collecting Client Personal Information

4.1. A Service Order is placed by the Client through the Billing system or by direct communication with the Hosting Provider using the contact channels indicated on the website.

4.2. When registering on the Hosting Provider's website, the Client undertakes to provide the following registration information:

4.2.1. The name of the Client or the person indicated by them;

4.2.2. E-mail address to which the details of the Service ordered by the Client will be sent;

4.2.3. Login in the billing system;

4.2.4. Actual country of residence;

4.3. The name, quantity, assortment, and price of the Service selected by the Client are indicated in the Client's cart on the Hosting Provider's Billing system website.

4.4. If the User requires additional information, they have the right to request it from the Hosting Provider.

4.5. When placing an Order through the Hosting Provider's contact channels (clause 4.1 of the Offer), the Client undertakes to provide the information specified in clause 4.2 of this Offer.

4.6. Acceptance of the terms of this Offer by the Client is carried out by the Client entering the relevant data into the registration form on the Hosting Provider's Billing system website or when placing an Order through the Technical Administrator. After placing an Order through the Technical Administrator, the Client's data is registered in the Hosting Provider's Billing system database. Having confirmed the Order for the selected Service, the Client provides the Hosting Provider with the necessary information in accordance with the procedure specified in clause 4.2 of this Offer.

4.7. The Hosting Provider is not responsible for the content and accuracy of information provided by the Client when placing an Order.

4.8. The Client is responsible for the accuracy of the information provided when placing an Order.

4.9. A remote service agreement between the Hosting Provider and the Client is considered concluded from the moment the Hosting Provider issues the Client with a cash receipt or other document confirming payment for the Service.

5. Service Delivery and Data Transfer

5.1. If the remote service agreement (hereinafter - the Agreement) is concluded with the condition of providing the Service to the Client, the Hosting Provider is obliged within the period established by the Agreement to provide the data of the ordered service to the email address specified by the Client.

5.2. The order processing period is up to two business days after payment for the service.

5.2.1. Services are provided within 2 (two) business days after payment by the Client, based on 100% prepayment.

5.3. Information on mandatory confirmation of Service compliance is provided in the manner and ways established by the Hosting Provider's rules.

6. Client Obligations and Liability

6.1. It is prohibited to host information or software that is contrary to and/or prohibited by applicable international law, including copyright and related rights law. This includes pornographic materials, including links and advertising on such topics.

6.2. It is prohibited to create and host forums, social networks carrying suicidal, drug-related, sectarian, or terrorist content.

6.3. It is prohibited to host servers displaying false information about the number of players on any gaming platforms.

6.4. It is prohibited to upload malicious files to the server - i.e., files that could disrupt the operation of the Hosting Provider.

6.5. It is prohibited to use network scanner scripts, proxy checkers, and similar software.

6.6. It is prohibited to conduct DDoS/DoS attacks on various services, as well as to test DDoS/DoS attacks using the Services provided.

6.7. It is prohibited to conduct mass email campaigns, except when such actions are coordinated with the Hosting Provider.

6.8. It is prohibited to install and/or use systems or system elements for servicing, calculating, and operating digital currencies (mining, cryptocurrency extraction, distributed platforms, creating new blocks with the possibility of receiving rewards in the form of new units and fees, etc.) using the Services provided.

6.9. In case of violation of clauses 6.1–6.8, the Client is given 24 hours to rectify the violations. If requirements are ignored, the Hosting Provider has the right to prematurely terminate the Client's Service without the possibility of a refund.

7. Hosting Provider Obligations and Liability

7.1. The Hosting Provider provides Services in accordance with the information stated on the website.

7.2. After completing and fully paying for the Service, the Client receives all necessary credentials to manage the ordered service.

7.3. The Hosting Provider provides disk space without taking into account space occupied by the server's operating system.

7.4. The Hosting Provider guarantees the provision of appropriate quality Services and prompt elimination of malfunctions in the shortest possible time.

7.5. Hosting Provider employees have the right to carry out planned/unplanned (in case of unplanned failures or force majeure circumstances) technical work at any time of day.

7.6. The Hosting Provider is not liable for problems arising from the Client installing third-party software.

8. Domain Name Registration and Transfer Policy

8.1. The Hosting Provider provides services for domain registration, re-registration (renewal), and other services through an accredited domain registrar, in accordance with the list of services available on the registrar's official website.

8.2. Registration and maintenance of second- and third-level domain names in zones available for registration are carried out in accordance with the approved Domain Name Registration Rules determined by the Registrar or the Domain Name Registry in the selected zone. In case of discrepancies between the Rules and the terms of this Agreement, the Rules shall prevail.

8.3. The Customer agrees to the storage of their personal data in the Registrar's database and consents to the Registrar processing the following personal data: last name, first name, patronymic; date of birth; place of residence; citizenship information; ID document number, date of issue and issuing authority; contact phone numbers; email addresses.

8.4. Information on the prices of domain registration and renewal services in available zones is published on the Hosting Provider's website. The final cost of the service is determined by the Registrar at the time of submitting the domain name registration application.

9. Online Payment Security

9.1. Orders can be paid by Visa or Mastercard bank cards, or via other supported payment methods. To complete a payment, you will be redirected to a secure payment processor page where you will need to enter the required details. Card payment security is guaranteed by the payment processing center.

9.2. The payment system holds a confirmed certificate of compliance with PCI DSS requirements in the area of storing, processing, and transmitting cardholder data. The PCI DSS bank card security standard is supported by international payment systems including MasterCard and Visa. Your confidential data required for payment (card details, registration data, etc.) do not reach the online store - they are processed on the payment processing center's side and are fully protected.

9.3. The personal information you provide (name, phone, email, payment data) is confidential and not subject to disclosure. Payment data is transmitted exclusively in encrypted form and is not stored on our web servers.

9.4. The Hosting Provider uses third-party internet acquiring systems, and payment occurs on secure payment pages of payment aggregator processing systems.

9.5. When selecting a payment method, you are taken to a special secure payment page where you must enter the required payment details. For bank cards, the 3D Secure protocol is used for additional authentication. If your Bank supports this technology, you will be redirected to its server for additional identification.

9.6. When enabling the Auto-payment feature, the Client consents to funds being charged from the linked bank card to pay for ordered services.

9.7. The Client has the right to disable the auto-payment feature at any time by removing their bank card from the Hosting Provider's billing system.

9.8. If you have questions about how the payment system works, you can contact the Customer Support of your chosen payment service. Contact information is provided at the data entry stage.

10. Refund Policy

10.1. The maximum refund period is 14 (fourteen) business days to the account from which payment was made.

10.2. If losses were incurred by the Hosting Provider due to the fault of the Client receiving a refund (server/network shutdowns, IP address blacklisting, etc.), the amount of losses incurred by the Hosting Provider is deducted from the refund amount.

10.3. A Client may be denied a refund if fraud or violation of the terms of service described in this Offer is established.

10.4. Refunds are possible for:

• Client funds held in the Hosting Provider's Billing system balance
• Payments for services, only for full unused month(s)
• Payments for additional server resources, for full unused month(s)
